Hi,
I have a question. I am on H1 and are planning to extend my H1 along with my wife H4. My question is, we both have EAD's and I never use EAD. My wife is looking for jobs on EAD. If she works on EAD, can she still able to extend H4 status?

My H1B 6th Year expires August 2007 and need to apply for 7th year extension.
The below are options I read in murthy.com
1. Labor pending or approved before 365 days of H1B 6th Year expires
2. I140 Approved
Applied for PERM labor in April 2007 and still in pending status (First option ruled out)
After looking at July 2007 Visa Bulletin immediately Applied for I140 using Substitution Labor . Assuming that I can work on EAD.
And because of Revised Visa Bulletin I could not apply for I485.
Can I apply for 7th year extension based on I140 receipt (using Labor substitution)?
If no to the above question and suppose if my PERM labor is approved some time in July and if the USCIS start again the Premium for I140 Can I apply for another I140 from same employer?
Please reply ASAP,

My wife got a job offer on contract basis for 3 months. I am on h1 and she is on h4 so far. I am planning to stay on h1 itself. If my wife accepts this job using EAD, Does my status also changes? Is it okay if she dont find a job after this contract expires, what status she will be in during that time, h4 or EAD?

No..your status will not change. You can still maintain your H1. She can go on EAD and work for 3 months and she will be in AOS status if she does not find any job. She will not go out of status. She can work 40hrs, 20hrs or 0hrs..it will not affect her status.

i did not receive any correspondence for my I140 as well as for my labor.
My company provided me with a copy of my approved I140 (scanned) but refused to share any info on the approved labor.

USCIS might re-start PP for I-140 once they complete receipting 485 applications and EAD, AP approvals for July and August filers..which may take atleast 3 to 4 more months!!

Thank you for the response. I correct myself, I shouldn't say Visa. I mean Approval Notice. With the approval notice in hand which is effective May 2007, can I switch employers before that and get a transfer of H1 for the 3 years based on that or will I have to wait till May? Thanks!

I don't think that would work. Here are a couple of articles that seem to suggest that you cannot create your company on H-1B (http://www.laborimmigration.com/2008/01/starting-own-company-on-h-1b-visa/) and also that you cannot volunteer to do a job which would otherwise by a paying job (http://www.laborimmigration.com/2008/02/unpaid-volunteer-work-on-h-1b-h-4-or-f-1-visas/)

Careful! B4 GC is issued, you will have to show proof that you are still with the sponsoring company or working in a similar job /similar pay with another company.
1) b4 you leave the job make sure your i-485 has been pending for over 180 days
AND
2) Your i-140 is APPROVED
